Motion made by Selectman Cahalane to approve the Regular Session
minutes of Monday, March 17, 2008 as presented.
Motion seconded by Selectman Myers.
VOTE: Unanimous. 4-0.

NEW BUSINESS:
Fire Chief – Request to Adjust Ambulance Billing Rates:
George Baker, Fire Chief attended the Selectmen’s Meeting to request approval of a new ambulance fee schedule. Chief Baker recommended the Board add a rate for Advanced Care 2 and increase the base fee charges to reflect 120% of the Medicate allowable rate.
The adjusted billing rates were reflected in a memorandum addressed to the Town Manager dated March 25, 2008.
Motion made by Selectman Cahalane to accept the Fire Chief’s recommendation for new ambulance fees as outlined.
Motion seconded by Selectman Taylor.
VOTE: 3-1. Motion carries.
Selectman Myers in opposition.
Request of Mashpee Community Concert Committee, Inc., One Day Wine & Malt License for Mashpee Night at the Pops/Fee Waiver:
Chris Ball, Mashpee Community Concert Committee was in attendance to request the Selectmen approve a one day wine & malt license for the annual Mashpee Night at the Pops to be held on Saturday, July 26, 2008 with a rain date on July 27th waiving all Town fees associated to the event.
Motion made by Selectman Cahalane to grant the Mashpee Community Concert Committee a One Day Wine & Malt License on July 26, 2008 with a rain date of July 27th and waive all Town fee’s for the non-profit event to be held at Mashpee Commons.
Motion seconded by Selectman Myers.
VOTE: Unanimous. 4-0.
Request to Expend Funds – Waterways Assistant Wages:
Correspondence was received from the Harbormaster and Shellfish Constable dated April 4, 2008 requesting the Selectmen authorize the expenditure of $3,000 from the Waterways Improvement and Maintenance Account to the Waterways Assistant Wages Account to fund Waterways Assistant wages through June 30, 2008.
Mr. Ellis and Mr. York were in attendance and noted there are ample funds in the improvement and maintenance account for the transfer.
Motion made by Selectman Cahalane to authorize the transfer of $3,000 from the Waterways Improvement and Maintenance Account to the Waterways Assistant Wages Account as requested.
Motion seconded by Selectman Myers.
VOTE: Unanimous. 4-0.
Recommendation for Bid Acceptance – Temporary Library Space:
Two proposals were received in response to the Invitation for Bids for the rental of space for the relocation of the library during the construction of a new library building.
Mashpee Investors LLC was the recommended bidder for a fixed lease of $65,000 plus utilities. The rental space is located at 5-7 Joy Street in South Cape Village. The term of the lease would commence on approximately May 19, 2008 and will remain in effect for a maximum of 22 months.
The Planning & Construction Committee, the Town Manager and Director of Public Works are in support of the relocation of the library to the rental space in May to preclude any disruption to the library’s operation. Funding for the lease is within budgetary assumptions.
Motion made by Selectman Cahalane to accept the bid proposal from Mashpee Investors LLC in the amount of $65,000 for the lease of space for the Mashpee Library as described.
Motion seconded by Selectman Taylor.
VOTE: Unanimous. 4-0.
APPOINTMENTS AND HEARINGS:
Brad Tripp – Pesticide & Herbicide Use at Schools:
Brad Tripp, Facilities Manager of the Mashpee Public Schools was in attendance to request the Selectmen grant approval of the use of pesticides and herbicides on school grounds outdoors. Under State statute, written approval is necessary from the Chief Elected Municipal Body.
Mr. Tripp indicated that he intends to apply pesticide and herbicide treatments around the school buildings. Authorization is not required to apply treatments to the athletic fields. Mr. Tripp indicated that he is not aware of the Town’s policy regarding the use of 100% organic materials, but would consider the use of organic at a 50/50 ratio given the high cost of organic treatments and budgetary constraints.
Motion made by Selectman Myers to grant written approval to the Mashpee School Department for the use of pesticides and herbicides on school grounds other than athletic fields.
Motion seconded by Selectman Taylor.
VOTE: Unanimous. 4-0.
Motion made by Selectman Myers to request Brad Tripp consult with the Director of Public Works with regards to the Town’s pesticide and herbicide programs, and when possible to use organic treatments on the school grounds.
Motion seconded by Selectman Taylor.
VOTE: Unanimous. 4-0.
NEW BUSINESS:
Recommendation for Appointment – Waterways Commission:
Correspondence was received from the Waterways Commission dated February 5, 2008 recommending the appointment of Kenneth Bates to fill the vacant position. A letter of interest was received from Mr. Bates dated January 10, 2008 to serve as a Waterways Commission member.
Motion made by Selectman Cahalane to appoint Kenneth Bates of Mashpee to the Waterways Commission.
Motion seconded by Selectman Taylor.
VOTE: Unanimous. 4-0.
Recommendation for Appointment – Historic District Commission:
A letter of interest was received from Wayne Picard for appointment to the Mashpee Historic District Commission as a primary member. Mr. Picard is employed by Yarosh Associates as an Architectural Project Manager.
Motion made by Selectman Cahalane to appoint Wayne Picard to the Historic District Commission.
Motion seconded by Selectman Myers.
VOTE: Unanimous. 4-0.
Application of Mashpee Wampanoag Rod & Gun Club – One Day Liquor License:
Courtenay Mills, Mashpee Wampanoag Rod & Gun Club was present to request the use of the club’s 2008 liquor license on Saturday, April 26, 2008.
Motion made by Selectman Myers to grant a One Day Liquor License to the Mashpee Wampanoag Rod & Gun Club on April 26, 2008.
Motion seconded by Selectman Cahalane.
VOTE: Unanimous. 4-0.
COMMUNICATIONS & CORRESPONDENCE:
Intergovernmental Agreements:
The Selectman agreed to consult the Mashpee Wampanoag Tribal Council to consider a mutual date to execute the Intergovernmental Agreements.
Benefit Memorial Ride:
The Board was supportive of a benefit memorial motorcycle ride on Saturday, April19, 2008 through the Town of Mashpee from 10:00 a.m. to 10:30 a.m. The event is being coordinated with the Mashpee Police Department.
APPOINTMENTS AND HEARINGS:
Public Hearing – Mashpee Commons Entertainment:
The Board of Selectmen opened the Public Hearing on the application of Mashpee Commons Limited Partnership to provide entertainment to the public from May 1, 2008 through December 31, 2008.
The Hearing notice was read aloud in accordance to posting requirements. Lissa Daly, Mashpee Commons LLP was in attendance for discussion purposes.
To conform to requirements of the ADA Committee, it was noted that there are no changes to the intended entertainment to prohibit handicap accessibility.
Being no comment, the Board motioned to close the Public Hearing.
Motion made by Selectman Cahalane to close the Public Hearing.
Motion seconded by Selectman Myers.
VOTE: Unanimous. 4-0.
Motion made by Selectman Cahalane to approve the application of Mashpee Commons LLP for entertainment at Mashpee Commons as described.
Motion seconded by Selectman Taylor.
VOTE: Unanimous. 4-0.
